1. Acceptance of Terms
By accessing or using the OpsRift service ("Service") operated by OpsRift ("Company," "we," "us," or "our") at www.opsrift.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
OpsRift provides an AI-powered incident postmortem generation platform designed for operations teams. The Service analyzes incident data you provide and generates structured postmortem reports to help teams document, learn from, and improve response to incidents.
3. User Accounts
You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information when registering.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not: (a) use the Service to violate any applicable laws; (b) transmit malicious code or attempt to gain unauthorized access to our systems or other users' data; (c) use the Service to generate content that infringes intellectual property or privacy rights; (d) resell or redistribute the Service without authorization; or (e) interfere with or disrupt the Service.
5. Intellectual Property
The Service, including its design, features, and underlying technology, is owned by OpsRift and protected by intellectual property laws. You retain ownership of the incident data you submit. By using the Service, you grant us a limited license to process your data solely to provide the Service. Generated postmortem reports are yours to use, modify, and distribute.
6. Payment and Billing
OpsRift is a subscription-based service offering free and paid tiers. Paid plans are billed in advance on a recurring basis (monthly or annually). You authorize us to charge your payment method for all fees incurred. Prices are subject to change with notice; continued use after a price change constitutes acceptance. 7. Cancellation and Refunds
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; you will retain access until then. We offer a full refund within 14 days of purchase, no questions asked. To request a refund, contact gigakovaliovi@gmail.com. Refunds are processed through our payment provider Paddle within 5-10 business days.
8. Limitation of Liability
To the maximum extent permitted by law, OpsRift and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate or complete. You use the Service at your own risk.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, available at www.opsrift.com/privacy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.
11. Modifications to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Georgia.
